Clarification of the Prosecutor about the crimes of illegal sale of narcotic and psychotropic substances

Dear students and parents!

In recent years, cases of adolescents committing crimes in the sphere of illicit trafficking in narcotic drugs and psychotropic substances.

As a rule, Teens are engaged in illegal sale of drugs through the use of caches and Bank accounts. Bookmarks, as a rule, carried out by teenagers (boys and girls) of different social groups (from families of middle and high-income, disadvantaged and advantaged).

Teenagers-distributors carry out the purchase of drugs for resale and exercise withdrawal of cash from the accounts.

The involvement of minors in drug trafficking takes place through the use of various software applications messengers installed on smartphones.

Through these messengers associated with teenagers so-called "courier" that offers a quick and easy way to earn big money, namely: to proceed to the specified address, to take the substance packaged in the package, and to take it to another specified address ("cache") and safely hide while photographing "their work" and sending a "report". Then, the teen receives money for "work".

However, the organizers of the sale are not warning Teens about the criminal liability for such activities under article 228.1. The criminal code of the Russian Federation "illegal sale of narcotic drugs, psychotropic substances or their analogues, and also illegal sale of plants containing narcotic drugs or psychotropic substances or their parts containing narcotic drugs or psychotropic substances"

The Commission of this crime shall be punished by imprisonment for the term from four up to eight years.

If the sale of drugs, psychotropic substances or their analogues, committed by using the mass media either electronic or information-telecommunication networks (including network "Internet"), then such offence shall be punishable by deprivation of liberty for a term of five to twelve years.

If the offence is committed by a group of persons upon a preliminary collusion, or committed sale of drugs in large amount, the offence is punishable by deprivation of liberty for a term of eight to fifteen years.

If there is a sale of drugs on a large scale, this offence is punishable with imprisonment for a term of ten to twenty years.

Well, if the sale of drugs was committed in especially large size, such a crime is punishable by deprivation of liberty for a term from fifteen to twenty years.

Dear Teens and parents, modern technology allows the bodies of internal Affairs to arrange the technical ability to track this kind of "communication" and "conversation" in messenger, and then carry out quickly-search actions for establishment of distributors of drugs.

Also, I want to emphasize that the current judicial practice suggests that courts considering criminal cases on drug trafficking, prescribe punishment in the form of real deprivation of liberty, even despite the fact that the dock is a minor! Thus, I draw your attention that in the pursuit of quick and easy, at first glance, the earnings you can lose the most expensive - the FREEDOM!
